Prohibited Activities

Publisher (which for purposes hereof includes the term “Partner”) expressly agrees only creative provided by or approved by Digital Turbine in writing will be used by Publisher in promoting Advertisements.  Publisher shall ensure that Advertisements are not promoted through the use of any message or notification which mimics or resembles operating system dialogue boxes, error messages, or similar;

Publisher expressly agrees not to:

(i)      re-order, modify, edit, obscure or truncate in any way the Advertisements, including without limitation, the Advertisements’ content, graphics, format, audio, video, sequence, or any other aspect of the Advertisements, without Digital Turbine’s explicit prior written consent, including;

(ii)     distribute or display any Advertisements on any website(s) or application(s) that contain: (A) firearms, explosives, or weapons, or instructions on how to assemble or otherwise make any of the same; (B) content that may be unsuitable for or harmful to children under the age of thirteen (13); (C) pornography, sexually explicit adult entertainment, prostitution or escort services or products,  or otherwise offensive or indecent content; (D) drug, tobacco or alcohol related, including controlled substances or pharmaceuticals; (E) fraudulent, counterfeit or stolen products or services or pirated computer programs; (F) registered or unregistered securities; (G) illegal or unlawful content, products or services; (H) promotion(s) of hate and bigotry, act(s) of violence or terrorism, or commission(s) of crimes or illegal activities; (I) products or services from a United States’ embargoed or blacklisted country, individual or entity; (J) content which reasonably could be deemed to be libelous, defamatory, scandalous, threatening or harassing; (K) content which is related to political or religious activities; (L) gambling, betting, games of chance or similarly related activity, whether concerning real or virtual currency or items of any kind (or both); (M) content which violates or misappropriates any third party intellectual property, moral, privacy or other right; (N) other content that Digital Turbine reasonably believes might damage Digital Turbine’s or its advertisers’ brand or reputation; and/or (O) Content which could cause Digital Turbine to violate any law or regulation; 

(iii)    promote Advertisements using icon dropping (where a second application icon is dropped silently along with the host application), icon placement, push notifications to a consumer's device, pop-up's or pop-under's except where they fully comply with Google Play and IAB policies,  non-consumer initiated directs to app store, and bookmarking or any other form of advertising that creates a permanent/semi-permanent link on a user’s device;

(iv)    without seeking and obtaining Digital Turbine’s prior written consent, remove or change any tracking codes or web beacons included in the Advertisements deployed by Digital Turbine;

(v)     frame or resize, minimize, remove or otherwise inhibit the full and complete display of any third-party website accessed through an Advertisement on a web page (the “Advertiser Page”) including by redirecting a user away from any Advertiser Page, providing a version of the Advertiser Page that is different from the page a user would access by going directly to the Advertiser Page, interspersing any content between the Advertisement and the Advertiser Page, or otherwise providing anything other than a direct link from an Advertisement to an Advertiser Page;

(vi)    re-broker, re-sell or otherwise transfer by Publisher any Advertisements to other networks not owned or controlled by the Publisher.  Under no circumstances should any Advertisements be directly or indirectly allowed to be accessed by this list of companies that shall be periodically updated on the link below:

 (vii) Shall not engage in activities such as  Real-Time Bidding [RTB], Google Paid Search and Facebook advertising where expressly prohibited by advertiser for that campaign;

(viii)    directly or indirectly access, launch, or activate Advertisements through or from, or otherwise incorporate the Advertisements in, any email or third-party software application, download, website, or means other than the sites comprising the Publisher Network;

(ix)    “crawl”, “spider”, index or in any non-transitory manner store or cache information obtained from any Advertisement, or any part, copy or derivative thereof;

(x)     accept and transfer to Digital Turbine any personally identifiable information;

(xi)     generate impressions of or clicks on any Advertisement through any automated, deceptive, fraudulent or other invalid means, including, but not limited to, repeated manual clicks, installs and/or automated query tools;

(xii)    promote Advertisements using incentivized ad units or display any ad unit that encourages users to click on Advertisements through incentives or place statements near any Advertisement that encourages users to click on the Advertisement (e.g., “Please click here”) or to visit the third-party advertiser (e.g., “Please visit our sponsor”);

(xiii)    in any way minimize or obstruct the display of any Advertisements, or edit, modify, filter or change the order of the information contained in any Advertisements;

(xiv)   attempt to edit the website tags, source codes, links, pixels, modules, software development kits or other data provided by Digital Turbine;

(xv)   reverse engineer, decompile or disassemble any software components of the advertising services provided by Digital Turbine;

(xvi)    send spam or otherwise duplicative or unsolicited messages in violation of applicable laws or to send messages to any purchased (email) lists, purchased distribution lists, purchased newsgroups, or purchased email addresses;

(xvii)   perform or facilitate any act which, directly or indirectly, causes to be transmitted to, uploaded by or downloaded by, any end user any “junk mail”, “spam”, “chain letters”, “pyramid schemes”, or any other like form of solicitation;

(xviii)   perform or facilitate any act which, directly or indirectly, causes to be transmitted to, uploaded or downloaded by, Digital Turbine or any end user any software viruses, worms, Trojan horses, time bombs, trap doors or any other computer code, files or programs or repetitive requests for information designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment or to diminish the quality of, interfere with the performance of, or impair the functionality of Access Points;

(xix)  perform or facilitate any act which interferes with or disrupts Access Points or servers or networks connected to Access Points;

(xx)    partner shall ensure that all Digital Turbine ad units render completely and that consumers explicitly engage with the ad unit to demonstrate the intention of being directed to the app store;

(xxi)    contact any user or any individual who has asked not to be contacted; or

(xxii)    impersonate any person or entity or falsely state or misrepresent your affiliation with another person or entity, including without limitation, Digital Turbine.
